Price list and IMPORTANT information

Contract:

When the contract (signed agreement) is signed, a nonrefundable depositum of 20% of the total price will be invoiced the client. The deposit must be paid in its full BEFORE the shooting day. The remaining 80% of the price will be invoiced to the client after delivery of the produced content.

The depositum will not be paid back IF:

- The client cancels the shoot less than seven days before the shoot

- The client cancels the shoot less than 24 hours before the shoot if the client signed the deal less than a week (seven days) before the shoot.

 

Copyright:

Weddings.

The couple will not be permitted to edit the material themselves, but will receive a lifelong right of usage of the material. The couple can freely share and distribute the material, as long as proper credit is given (Olav Johan Graff/@olavgraffvisuals) to the creator. Physical prints of photographed material will for copyright reasons be provided by the creator himself, and the prices may vary due to different costs from different retailers. Prints with watermark will come at an additional cost of kr. 1500,- and prints without a watermark will come at an additional  cost of kr. 2500,- 

The additional costs are added to the cost of the printing provider's own costs. 

A memory stick (chosen by the photographer) with the material will be provided at no additional cost. If the couple requests a special stick, say a golden memory stick, the couple will have to provide the photographers an additional fee of kr. 1500 for the photographers hard work to find such a stick, plus a fee of whatever the special memory stick costs :)

The rights of use are transferred to the children or closest next of kin after demise.The children or next of kin, still has to credit the photographer.

Festivals, Concerts, Sports, other events and other services:

The material provided by the photographers cannot be shared with a third party without Olav's (the creator('s) ) consent. If a third party wants material from the creator, they need to contact the creator himself. 

Deals that involves use of the creator's material cannot be signed between the client and the third party.

Deals can only be signed between the creator and the third party, but the client can demand a right to approve or deny any deals between the third party and the creator. 

The client MUST refer interested third parties to the creator for further deal agreements.

The client or other third parties CANNOT edit the material provided by the creator, unless special permission is given in written form to do so, usually provided if the client want's to turn the photography into a black and white photography. Editing INVOLVES: cutting, masking, light editing, heavy editing, color grading, added texture, and everything else an editing software can do.  

These agreements are to protect the creator's work from unlawful copying and illegal editing.

 

Special agreement for festivals/conferences/commercial actors icl. artists:

The creator includes a one year (365 days) right for the client to use the material provided without any additional costs (excluding infringement fees). After the 365 days, the client will have to request new permissions for every material they want to re-use, excluding social media posts posted before the 365-day deadline (Promoting old posts still requires the client to send a new request, as this goes under re-using the material).

The price for re-using PHOTOS are kr. 2 500 every quarter (1st of January, 1st of April, 1st July, 1st October) per photo.

The price of re-using films are kr. 10 000 every month per film. 

 

Common copyright agreements:

- No clients can give a third party permission to edit or distribute (share) the material.

 

Infringement fee:

An infringement fee will be sent to the client if any of the copyright agreements are violated. If the client chooses not to pay the infringement fee, the photographer will take the case to conciliation or to court.

 

Fees:

kr. 5 000

for every photography shared by the client without the creator's consent, this applies also to any third party who has received or unlawfully downloaded or copied material from the client or the client's sources (Social media, web-page etc).

 

kr. 20 000

for every video material shared by the client without the creator's consent, or unlawfully copied, downloaded and/or distributed by a third party.

 

The fees will repeat weekly until the problem has been resolved. Any third party MUST take down all stolen (unlawfully downloaded, copied) material shared. Printed material must be burned/maculated to prevent other third parties from illegally stealing material disposed in the garbage.

Third parties are financially responsible for paying if any other fourth party (public viewers, third party's clients, workers) has unlawfully shared or downloaded unlawfully shared or downloaded material by the third party. Example:

Client shares a post --> Third party unlawfully downloads material --> Third party shares unlawfully downloaded material --> Fourth party sees, and likes the material --> Fourth party continues to unlawfully download unlawfully downloaded material from the third party --> Fourth party edits the material --> Fourth party share with friends --> other fourth parties download from fourth party number one --> Nobody really cares anymore who made the content --> The photographer loses income.
